If you provide services to an immigrant who has been battered, there are some important tips to remember:
- Do not call federal immigration authorities, such as INS or Border Patrol, to figure out the legal status of your client. Your client could be deported as a result of your call.
- Remember that your "illegal" or undocumented client still has the right to be safe. Don't automatically assume that because the domestic violence victim is here "illegally" without legal status that he or she has no rights. Immigrant domestic violence victims have the right to call the police, get a protection order, or get a divorce.
- Be sensitive to an immigrant's background and culture. Every immigrant comes from a unique ethnic and cultural background. Moreover, many immigrants are afraid of coming forward to get help because of their immigration status. Be aware of their fears of seeking help.
- MOST IMPORTANTLY ... Contact the Battered Immigrant Project or another immigration attorney to find out about your client's rights.
