Several agricultural employers are seeking workers for agricultural jobs in Michigan that will pay at least $17.34 per hour. The following chart lists the jobs available in Michigan. These jobs are open to any qualified job applicant, including migrant and seasonal farmworkers anywhere in the U.S. These jobs are often called “H-2A jobs” because if an agricultural employer cannot find enough U.S. workers to fill these jobs, the agricultural employer can bring foreign workers to Michigan under the federal “H2A visa” program. However, the H-2A program has specific requirements that an employer must follow, which are meant to protect U.S. workers from being displaced by H-2A visa holders. For example, the employer must hire all able, willing, qualified and available U.S. workers who apply for these H-2A jobs before the “50% of the contract.”
In addition, all workers, including U.S. workers, who apply for and obtain these “H-2A jobs” have the right to the same terms and benefits of employment. Examples of benefits available to all workers employed in these jobs include:
- Free and licensed housing, if the worker does not live within commuting distance
- The cost of travel from the place of recruitment to the job site, if the worker completes 50% of the contract
- The cost of travel back home, if the worker completes the contract period
- A record of the amount of work performed and amount paid, including deductions
- Workers compensation insurance or its equivalent
If you are denied a job for which you believe you are qualified, because of your need for family housing, or any other unlawful reason, or if you are employed in one of these jobs and are employed in one of these jobs and do not receive the benefits identified above, call Farmworker Legal Services at 1-800-968-4046 to talk to an attorney for free. Farmworker Legal Services will counsel H2A visa holders about their rights under their contracts, U.S. workers who obtain these “H2A” jobs, and potential U.S. workers who are denied their right to obtain these jobs.
